Tennessee Laws on Pets in Restaurants
In Tennessee, the law generally prohibits pets from being inside restaurants. This is to maintain hygiene and food safety standards that are essential for public health. However, there are a few exceptions and specific rules.
Service Animals Are Always Welcome
Under federal and state laws, service animals that are trained to assist individuals with disabilities are allowed in all areas of our restaurant where customers are normally permitted. These animals are not considered pets but are vital companions that perform essential tasks.
Emotional Support Animals
It’s important to note that emotional support animals, while offering comfort and companionship, are not classified as service animals under the law. As of 2024, Tennessee has clarified that emotional support animals are not permitted inside food service establishments. This distinction helps maintain compliance with state and federal health codes.
Outdoor Dining with Dogs
If you love dining with your dog, you’ll be glad to know that Tennessee law allows municipalities with populations of 100,000 or more to create ordinances permitting dogs in outdoor dining areas. These rules come with specific health and safety conditions, such as:
- Dogs must remain on a leash at all times.
- Pets are not allowed to sit on tables or chairs.
- Restaurant staff may not handle or serve food to dogs.
Alabama Laws on Pets in Restaurants
In Alabama, similar regulations apply to ensure food safety and public health in restaurants. According to the Alabama Department of Public Health’s “Food Establishment Sanitation” rules (Chapter 420-3-22), pets are not allowed inside restaurants. These rules help maintain strict hygiene standards for food service establishments.
Service Animals
As in Tennessee, service animals are always welcome inside Alabama restaurants. They are protected under the Americans with Disabilities Act and are not classified as pets.
Emotional Support Animals
Emotional support animals are not recognized as service animals under Alabama law and are therefore not permitted inside food establishments.
Outdoor Dining with Dogs
Under Alabama Code § 22-20-5.3, restaurants may allow dogs in outdoor dining areas if specific conditions are met:
- Dogs must be on a leash or in a carrier and under control at all times.
- A separate outdoor entrance must be provided to prevent dogs from passing through the interior of the restaurant.
- Employees are prohibited from handling or serving food to dogs.
- The outdoor area must be kept clean, and pet waste must be promptly removed.
